Effective Date: February 17, 2024
The Digital Services Act (DSA) is a European Union (EU) regulation which came into force in EU law in November 2022 and is applicable across the EU. The DSA regulates digital services providers, including marketplaces such as BeatStars. BeatStars is fully committed to upholding the DSA and ensuring a secure digital environment. Here, we summarize our DSA compliance efforts. For more detailed information about our policies, please refer to our Terms of Service.
Information on Average Active Monthly Users
Under the DSA, we must share information about our 'average monthly active service users' to determine if we qualify as a 'very large online platform' (VLOP). A VLOP is an online platform with at least 45 million users per month in the EU.
Our 'average monthly active service users' comprise individuals based in the EU who have engaged with BeatStars within the last six months. These engagements include activities such as viewing or listening to content, as well as offering, buying, or selling content. Automated bots and scrapers are not considered in this count.
Following the Digital Services Act (DSA), BeatStars publishes information on its average monthly active users in the European Union (EU), calculated over a six-month period. For the six month period starting on 02/01/2023 and ending on 08/31/2023, we had approximately 291,140 average monthly active users in the EU.
BeatStars Inc. will continue to monitor the number of monthly users in the EU and publish updated information every six months, in accordance with Article 24(2) of the DSA.
Single Point of Contact
In compliance with the DSA, we have designated a single point of contact.
We promptly respond to regulatory inquiries and collaborate closely with users, rights holders, and law enforcement agencies to address questions and effectively counteract any misuse of our marketplace.
Legal Representative
If you need to contact our EU legal representative, please use the following information:
Professional Seller Traceability
We are required to trace our traders ("know your business customer - KYC"). To comply, BeatStars collects mandatory information from Professional Tier Subscribers, including identification, payment details, location, and other relevant data. We verify this information using identity validation technology and manual reviews before granting access to our marketplace. Additionally, we conduct random checks to mitigate risks, including verifying the compliance of content listed on the marketplace against existing databases.
We communicate with Professional Tier Subscribers when their information is incomplete, non-compliant, or incorrect. Failure to provide necessary updates may result in access suspension or additional measures. Users can find Professional Tier Subscribers information here.

BeatStars Notice and Action Mechanisms (N&A)
Users throughout the EU can report illegal or harmful content and policy violations here. BeatStars also actively moderates content and collaborates with trusted flaggers to address identified issues. When necessary, we take actions like content removal or account suspension while ensuring clear communication about the violations, offering guidance, and providing users the opportunity to appeal the decision.
User and trusted flaggers reports are of utmost importance to us, and we have measures in place to address any misuse of our systems. For individuals who repeatedly abuse the N&A mechanism, whether they are content uploaders or reporters, we implement restrictions to maintain a safe environment.
For more details about our content moderation check out our Terms of Service here.
Internal Complaint-Handling System and Dispute Resolution
We maintain an internal complaint-handling system accessible to users, especially for content moderation decisions. Users can appeal our content moderation decisions, including when these decisions are based on our Terms of Service here.
Users who remain dissatisfied with our decisions even after contacting our support teams, can seek resolution for most disputes through support@beatstars.com. We are committed to providing mechanisms for addressing concerns and ensuring fair resolutions.
For more details about our complaint-handling system and dispute resolution options, please refer to our Terms of Service here.
Advertising and Online Interface
We also provide users with information about the ads they encounter on our platform. This includes details about whether and why a particular ad is specifically targeting them.
We do not employ behavioral 'nudges' or other design choices that coerce users into making specific decisions.
Transparency Reports
We will publish all required transparency reports as mandated by the DSA and provide links here as they become available. This information will be updated at least once a year.
Conclusion
BeatStars is dedicated to constantly improving our tools and technology to ensure the safety of our users. We promptly address reported issues and use these incidents to enhance our prevention and monitoring efforts in the future.
